Terms and Conditions for the Use of Marmara App and Website
- Scope and Acceptance:
Your use of the Marmara app and website (hereafter referred to as "the App" or "the Website") constitutes your agreement to these terms and conditions, which represent an agreement between you and the company regarding the application of these terms. For the purposes of these Terms and Conditions of Use, "Marmara-iq.com" refers to "Etir Almasa for Perfume and Cosmetics Trading LLC.," an Iraqi company headquartered in Baghdad, Iraq. You also acknowledge that you are over 18 years of age, and the company reserves the right to restrict and terminate the account if it is found that the user is under 18 years of age. If you do not fully agree to these terms, you should not use the App or the Website.
- Account Registration and Data:
Users must log in to complete the purchase process and use some additional features of the App. In addition to this, we collect certain data to create your account, which will enable you to complete purchase transactions and provide better service to our customers, ensuring the protection and privacy of this data. This includes, (but is not limited to) your full name, phone number, and age, in addition to optional information such as gender and email address. The user guarantees that all information added to their account on the App or the Website is completely accurate. The user also acknowledges not to create more than one account.
The user bears full responsibility for any incorrect information entered and the company has the right to take all necessary actions if it suspects that the user is using false information or suspects identity fraud, among others.
- Payment:
We currently accept cash payments only. However, our services allow the use of points to pay for our products. In the event of adding an electronic payment gateway in the future, financial transactions will be processed according to specific terms that will be communicated to customers.
- Shipping, Returns, and Cancellations:
To deliver our products to our customers, we cooperate with a shipping company to deliver products to all provinces within Iraq. The company is not responsible for any errors or negligence by third parties.
The company does not provide a specific return policy, but the customer has the right to cancel the order after contacting customer service and reporting if there is a problem with their order. The company reserves the right to accept or reject the cancellation request if suspected otherwise.
Delivery of some products that are not in our stock may be delayed in addition to the normal delivery time by an additional day. If a product is unavailable from the supplier, we will inform the customer and offer an appropriate alternative or cancel the unavailable item from the list. If the customer wants to cancel the entire order, the company has the right to cancel or refuse to cancel the entire order.
The company reserves the right to cancel the order in case of:
- Suspicion of fraud or a fraudulent situation.
- Unavailability of the requested products.
- Error in your order.
- Error in product display.
- Point System:
Users can collect points through purchasing products and participating in games within the App. These points can be used as currency to purchase products. The user must immediately inform the company in case of any problem with the account or the point system. The company is not responsible for any misuse of the point system or wrongful purchases made by the user. We reserve the right to modify or change the point exchange rate at any time.
- Intellectual Property:
All original contents of the App are within the intellectual property rights related to the App and the Website, including but not limited to texts, graphics, icons, menu images, data sets, and software, and belong to Diamond Perfume Trading Company. Any unauthorized use will be considered a violation of our intellectual property rights, and our trademark and original intellectual property rights may not be used for any purpose without prior written consent from the company.
- Updates:
We reserve the right to modify these terms and conditions at any time. Users will be informed of any modifications through a notification on the App or Website or by notifying you through any electronic messaging methods, including but not limited to email or phone number. Continuing to use the site or app after modifications constitutes agreement to these changes, including those that increase your obligations or limit your rights.
- Account Termination:
The company reserves the right to suspend or terminate your account for any reason deemed appropriate by the company without prior notice or liability, including but not limited to: violation of any terms and conditions, providing false information about your account, or engaging in fraudulent activities. Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply cease using the service.
- Disclaimer:
We strive to provide accurate information on the App and the Website and work diligently to update and improve this information, but we do not guarantee the accuracy of all the information available, including but not limited to product names, descriptions, images, or prices. The company, the website, or the app are not responsible for any damages that may occur as a result of using the
products. The company, website, or app will not be liable for any damages that may result from product use.
Furthermore, the website, app, officials, employees, agents, and suppliers will not be liable under any circumstances for any direct or incidental loss or damage arising from or related to your use of the app or website, or its services, or this user agreement, regardless of cause, including negligence or otherwise.
If you are dissatisfied with the service and we do not have a solution to address your dissatisfaction with our provided services, the exclusive and only remedy is to stop using our services.
